Terms of use
MomentBackup is published by Watari Labs Pty Ltd (ACN 696 983 829 / ABN 84 696 983 829), an Australian company registered in New South Wales ("Watari Labs", "we", "us"). These terms work together with the End User License Agreement shown when you install the app and with our Privacy Policy. If there is any inconsistency about the licence itself, the End User License Agreement applies.
The license
MomentBackup is commercial software. A personal license package lets you install and use the app for personal, non-commercial use on up to the number of computers stated when you buy it. Every package has the same product features; only the computer allowance changes. You may buy more than one package, and each package adds its stated allowance.
You may move a license from a computer you stop using to its replacement, as long as the number of computers using your licenses at the same time stays within your total allowance. Business, school, and organisation use requires a separate written volume license from us. The trial grants the same use rights for its duration. You may not redistribute, resell, or reverse engineer the software except where law expressly permits. To download the trial, you must create a free MomentBackup account. No credit card is required.
Refunds
We offer a 14-day money-back guarantee. If MomentBackup isn't right for you, email us within 14 days of purchase for a full refund — no questions asked. Refunds are issued through our merchant of record, Polar (Polar Software, Inc.). This is in addition to any rights or remedies you have under the Australian Consumer Law or other applicable consumer law that cannot be excluded.
Your data is yours
Backups created by MomentBackup belong to you and live on storage you control. Uninstalling the app or letting a license lapse never deletes a backup, and restoring existing backups works without an active license.
The trial account
A free account is required to unlock the download and start one 21-day trial for that account. A second computer uses the same end date. You sign in with a one-time email link; there is no password and the account holds no payment details. The same account can re-download a paid license key and manage website sign-ins and show the account’s trial dates. A paid license activates offline and does not depend on the account service. Use the account only for yourself: keep sign-in links private, do not access another person's account, and do not probe or disrupt the service. We may suspend account access for misuse. That can remove trial-download and account access, but it never affects a paid license or existing backups. The account is governed by our Privacy Policy.
Back up like it matters
No backup product removes the need for judgment. Verify that restores work before you depend on them, keep more than one copy of anything irreplaceable, and keep your recovery key somewhere safe — if you lose your passphrase and recovery key, encrypted backups cannot be opened by anyone.
Consumer guarantees, warranty and liability
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law, and you may have similar rights where you live. Nothing in these terms excludes, restricts, or modifies those guarantees, rights, or remedies. Subject to those rights, and to the maximum extent permitted by law, the software is otherwise provided "as is" without other warranties, and our total liability for any claim connected with the software is limited to the greater of the amount you paid for your license or the minimum amount applicable consumer law requires.
Updates
A one-time license includes updates within the same major version. The app may check for and install updates to keep itself current and secure. We will not change the terms that apply to a version you already use in a way that materially reduces your rights without telling you and giving you the choice to stay on your current version.
Termination
These terms may end if you materially breach them and do not fix the breach within a reasonable time after we ask. Your existing backups remain yours and restorable, and the sections about your data, consumer guarantees, warranty, and liability survive.
Governing law
These terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of the courts of New South Wales. This does not deprive you of the protection of the mandatory consumer-protection laws of your place of residence, which continue to apply.
